Contract for Services
This is a contract between The Cat's Pajama's Inn (hereinafter called "The Inn") and the pet Owner whose signature appears below (hereinafter called "Owner"). Animals included in contract: ________________________________________________________ 1. The Inn agrees to exercise due and reasonable care to keep its premises sanitary and properly enclosed. 2. Owner agrees to pay the rate for boarding in effect on the date the pet/s is/are dropped off at the Inn. Owner also agrees to pay all costs and charges for special services requested and all veterinary cost for the pet/s during the time said pet/s is/are in the care of the Inn, and further agrees to pay the full rate for any extra nights resulting from late pick up with extra nights beginning after last possible pick up time for the scheduled pick up date. 3. The Inn does not assume and shall not be held responsible for any liability with respect to the animal/s listed in this agreement, of any kind, character, or nature whatsoever, arising out of or from boarding this animal/s, or any damages which may accrue from any other cause whatsoever including loss by fire, theft, running away, death, injury to persons, animals, or property, or death or injury to any other animal caused by the within named animal during the term of this contract, whether this animal/s be on the premises of the Inn or not, and the Owner of said animal/s agrees hereby to be and is solely responsible for any and all acts of behavior of said animal/s at any time within the term and time of the contract. The responsibility and/or liability of the Inn, in no event shall exceed the sum of Two Hundred Dollars ($200.00) and the undersigned agrees to limit the responsibility to Two Hundred Dollars ($200.00) and no more, and agrees not to claim any damages against said Inn of any nature whatsoever, either by way of contract, equity, negligence or otherwise, in excess of said sum. 4. The Owner of the within named animal/s specifically represents that he/she is the sole Owner of said animal/s and that there is not now any lien or mortgage against said animal/s. 5. The Inn shall have, and is hereby granted, a lien on the animal/s for any and all unpaid boarding and/or other charges resulting from the boarding of said animal with the Inn. 6. If the animal/s becomes ill, the Owner shall be notified at once, collect, if possible, or such attempt shall be made to so notify the Owner, and if Owner does not immediately inform the Inn regarding measures to be taken or if the state of the animal/s health requires quick action, the right to call a veterinarian or to administer medicine or to give advisable attention at the discretion of Inn shall be taken for granted by the Inn, and such expenses being reasonable in amount shall be promptly paid by Owner. 7. Any controversy or claim arising out of or relating to this contact shall be settled by arbitration in accordance with the rules of the American Arbitration Association. The arbitrator shall, as part of his award, determine an award to the prevailing part of the cost of such arbitration reasonable attorney's fees of the prevailing party. 8. This Contract contains the entire agreement between the parties. All terms and conditions of this agreement shall be binding on the heirs, administrators, and assigns of the Owner of the within named animal/s. 9. The Owner releases the Inn from any and all liability associated with injury to themselves or persons or other animals accompanying them to the Inn. Owner hereby acknowledges having read and agreed to this contract:
